Gift Card Terms and Conditions
- These Terms and Conditions (Terms) govern the purchase and redemption of virtual Gift Cards on our website https://amaefamily.com (Site).
- If you are purchasing a Gift Card, these Terms form a contract between you (the Purchaser) and Amae Family Ltd (we, us or our).
- If you are redeeming a Gift Card, these Terms apply to you (the Recipient) and govern your use of the Gift Card to book services with third-party service providers on our platform.
- By purchasing or redeeming a Gift Card, or by creating an account on the Site (Account), you agree to be bound by these Terms.
- Amae acts as an Agent on behalf of independent service providers.
Purchasing a Gift Card
For Purchasers:
- Gift Cards can be purchased from us on the Site. Gift Cards can be designated for:
- a specific business offering services on the Site (referred to as Service Providers);
- a specific category of services (for example, Sleep / Nutrition / Household / Holistic Wellness); or
- open value to be used with any Service Provider.
- When you purchase a Gift Card, details will be sent to you or your chosen Recipient by email or post. The Gift Card will include:
- a unique redemption code;
- instructions for redemption; and
- the expiry date.
- You must provide a valid email or postal address for yourself or the Recipient. You are responsible for ensuring the correct email or postal address is inserted for the Recipient. We are not liable if a Gift Card is sent to an incorrect email or postal address that you have inputted, including where an unintended recipient redeems the Gift Card.
- The Gift Card and any associated platform credit are not transferable for cash or redeemable for monetary payment under any circumstances and cannot be replaced if lost or stolen.
- You agree to pay all amounts to us for options selected by you at checkout, including the cost of the Gift Card, any service fees (for example, for personalisation) and any transaction or processing fees.
For Recipients:
- You do not need to create an Account to redeem a Gift Card, but you can do so if you wish. If you create an Account you can create a wish list and choose to share it with friends and families.
- To redeem your Gift Card:
- visit the redemption landing page at www.amaefamily.com;
- enter the unique redemption code;
- enter the email address associated with the Gift Card;
- Amae validates and authorises each voucher before the customer books with the Partner;
- select a general Gift Card, a bundle available via the Site or your chosen Service Provider (if not already designated); and
- communicate with and book your service directly with the Service Provider through the Site or off the Site (as per the Service Provider's profile on the Site), provided that you do not attempt to circumvent these Terms.
- Gift Cards expire 12 months from the date of purchase. Any unused credit will expire on this date and cannot be redeemed after. We will not send reminders of the expiry date.
- If the Gift Card value does not cover the full cost of the services, you must pay the remainder with another payment method directly with the Service Provider.
- Gift Cards cannot be used to purchase other Gift Cards.
- If the full value of a Gift Card is not used in a single booking, any remaining value will automatically convert into non-withdrawable platform credit associated with the Gift Card or the Recipient's Account (if applicable). This credit:
- may only be applied towards eligible services available through the Site;
- cannot be exchanged, refunded, or redeemed for cash or any cash equivalent;
- cannot be transferred to another person or external payment method;
- does not constitute electronic money, stored monetary value, a payment account, or a deposit held by Amae; and
- remains valid only until the original Gift Card expiry date, after which any unused credit will automatically expire.
Platform credit represents a limited contractual right to obtain services via the Site and has no standalone monetary value outside the Amae platform.
- Gift Cards cannot be transferred between Service Providers once redeemed.
Important: Services Are Provided by Third Parties
- The services you book using a Gift Card are provided by independent third-party Service Providers, not by us. We act solely as a platform facilitating the redemption of Gift Cards. While we take care in selecting Service Providers, we make no representations or warranties about the quality, safety, or suitability of any services.
- Service Providers are independent businesses that set their own terms and conditions, pricing, availability, and service policies. We recommend you review the Service Provider's terms before using the Gift Card to purchase their services.
- As independent service providers, Service Providers (and not us) are fully responsible for:
- the quality, safety, and delivery of their services;
- their own booking systems, cancellation policies, and refund terms;
- all liabilities arising from their services.
- We have no obligation to resolve disputes between you or the Recipient and any Service Provider. While we work with reputable Service Providers, we hold no liability for the services they provide.
Refunds and Cancellations
For Purchasers:
- Gift Cards and any associated platform credit are not redeemable for cash and cannot be returned for a cash refund (except in extenuating circumstances at our sole discretion).
- When you place an order for an e-Gift Card it can be used straight away. In doing so you agree to it being supplied immediately to you or a Recipient, and you acknowledge and agree that your right to cancel within the 14-day cancellation period (and therefore your right to a refund) will be immediately lost.
- When you place an order for a physical Gift Card, you have a right to cancel within 14 days of when you or the Recipient receives the physical Gift Card from us.
- To cancel, contact us by email at info@amaefamily.com or by post at 40 Dundonald Rd, London, NW10 3HR. Unless we otherwise agree, you must send the Gift Card back to us and bear the costs of doing so.
- We will refund you (including any delivery costs you paid when purchasing the Gift Card), within 14 days of receiving using your original payment method. We may deduct an amount from the refund for any damage to the Gift Card.
- You will lose your right to cancel if the Recipient redeems the Gift Card within the 14-day period. By purchasing a Gift Card, you consent to the Recipient being able to redeem it immediately, and you understand this will end your cancellation right.
For Recipients:
- Once you have redeemed a Gift Card and booked with a Service Provider:
- the Gift Card is non-refundable;
- refunds and cancellations are subject to the Service Provider's own terms and policies;
- we do not process refunds for services - you must arrange these directly with the service provider;
- if a Service Provider cannot fulfill your booking through no fault of your own, we will reinstate the Gift Card value for use with another provider.
- This does not affect your statutory rights under the Consumer Rights Act 2015.
Liability
- You, the Recipient, are responsible for use and safety of your Gift Card, and are liable for all transactions made using your Gift Card.
- Nothing in these Terms excludes liability that cannot be excluded by law, including liability for death or personal injury caused by negligence.
- To the maximum extent permitted by law, we are not liable for any indirect, consequential, or special damages.
- You acknowledge and agree that we and our officers, directors, employees and agents have no liability for any act or omission of a Service Provider, including if a Service Provider:
- discontinues their services or leaves the Site;
- is unable or refuses to honor a redeemed Gift Card;
- becomes insolvent or ceases trading; or
- fails to provide services to an acceptable standard.
General
- Lost or Stolen Gift Cards: We are not responsible if a third party uses your Gift Card code, except where it is delivered to an incorrect recipient due to our fault.
- Fraud and Suspicious Activity: We may decline or cancel a Gift Card where there is fraud, deception, or reasonable suspicion of illegal activities.
- Privacy: We collect and process personal data in accordance with our Privacy Policy, available on the Site.
- Governing Law: These Terms are governed by the laws of England and Wales. Each Party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts operating in England and Wales and any courts entitled to hear appeals from those courts and waives any right to object to proceedings being brought in those courts.
- Intellectual Property: We own all intellectual property rights in the Site and the Gift Cards. You agree not to copy or otherwise misuse our intellectual property without our written permission (for example, to reverse engineer or discover the source code of our intellectual property), and you must not alter or remove any confidentiality, copyright or other ownership notice placed on the Site or a Gift Card.
- Use of the Site: You agree to:
- keep your Account details safe and secure and not disclose them with any person;
- not circumvent or disable any content protection system or technical protection measure used in the Site;
- not copy or modify, in whole or in part, any of the content on the Site or on a Gift Card;
- not reproduce, retransmit, distribute, disseminate, sell, publish broadcast or otherwise commercialise any content on the Site or on a Gift Card to any third party; or
- not breach, or allow any third party to breach, any intellectual property rights in the content on the Site or on a Gift Card.
